Compliance · Fair Housing
Equal housing opportunity, without exception.
Clearly Sold is committed to the Fair Housing Act and to serving every home seeker with the same professional standard. This page explains the law as it applies to our work, the 55+ housing exemption, and how to report discrimination.
The Fair Housing Act
The federal Fair Housing Act prohibits discrimination in the sale, rental, and financing of housing based on protected characteristics. It applies to landlords, sellers, lenders, and real estate professionals, including advertising, showings, offers, and negotiations.
Protected classes
- Race
- Color
- National origin
- Religion
- Sex (including sexual orientation and gender identity under HUD guidance)
- Familial status (presence of children under 18)
- Disability
Arizona state law provides similar protections, and some Arizona cities add additional protected classes beyond federal law. We follow the stricter standard that applies in each market.
The 55+ housing exemption
Communities marketed as active adult or 55+ may operate under the Housing for Older Persons exemption, which allows age-based occupancy rules when specific conditions are met, including that at least 80% of occupied units have at least one resident 55 or older. These communities are still bound by all other fair housing protections. We help every buyer understand the age rules of a community and verify them in writing before a purchase.
Our commitment
Clearly Sold provides professional services to all persons without regard to protected characteristics, and we display the Equal Housing Opportunity logo as a public commitment to that standard. We do not steer buyers toward or away from neighborhoods, and we present every option fairly and completely.
How to report discrimination
If you believe you have experienced housing discrimination, you can file a complaint with the U.S. Department of Housing and Urban Development (HUD) at no cost. HUD's Office of Fair Housing and Equal Opportunity handles complaints, and the HUD discrimination hotline is 1-800-669-9777 (voice/TTY).
